Finding the right person to help with an off-campus housing issue

Students who have an issue with their off-campus housing situation don't always have a clear understanding of who they need to speak with to resolve the problem.

Legend Real Estate office manager and co-owner Suzanne Metler said BYU students should contact the HOA management of the owner or manager of their unit.

Individual condos within the same complex can have different owners, and each owner can choose to manage their own unit or hire a management company to manage the unit for them.

Metler said tenants should ask who is responsible for different aspects of management upon signing a lease.

Apartments within a complex are typically all owned by one person or company, who may employ a separate manager. Apartments don't have HOAs, so the owner or manager is the person to contact about all issues.

HOA management is responsible for:



  • Parking
  • Exterior/outside amenities
  • Pool
  • Snow removal
  • Potholes on the property (potholes in the public street are the city's responsibility)
  • Landscaping
  • Common area condition and usage
  • Pest control — outside the units
  • Common areas — outside the units
  • Tenant complaints between units
  • Maintenance that affects multiple units, such as backed up main lines, water leaks from the roofing, etc.
  • Special projects to maintain the property
The owner/manager is responsible for:



  • Fixed assets -- walls, floors, electrical, plumbing
  • Furniture in the apartment
  • Appliances
  • Carpet
  • Cabinets
  • Bathroom fixtures
  • Pest control — inside the unit
  • Tenant complaints (between roommates inside the unit)
  • All maintenance in the unit (plugged toilet, broken stove/oven, washer/dryer, etc.)
  • All contract issues
  • All issues regarding deposit and rent, fees, etc.
