    WEST POINT ? Housekeeping services in Utah do not traditionally include topless women serving clients breakfast in bed.

    Black Rose Enterprises offers just that and more.

    The company?s Web site boasts itself as ?Utah?s and Arizona?s only bikini, lingerie and topless maid service,? but it may not be in Utah much longer.

    Thursday, the Utah Court of Appeals upheld the city of West Point?s decision to deny owner Dee Dee Derian?s business license because she violated residency conditions.

    Rick Davis, West Point city manager, said Derian failed to comply with the city?s ordinance requirements for a home occupation business license.

    ?The word occupation is what we wanted her to pay attention to,? Davis said. ?We discovered that she was not living in her home at all, but was running her business remotely, by cell phone.?

    Davis said Derian was licensed for an accounting and scheduling business in West Point, but she operated her maid services in other cities. Claims the city denied her a license based on the nature of her business are false, he said.

    ?Saying the license was denied because of the kind of business she was running is a smoke screen,? Davis said. ?This is not an LDS versus non-LDS issue. The true issue involved is her inability to comply with license requirements.?

    W. Andrew McCullough, Derian?s attorney, told the Salt Lake Tribune he doesn?t see the problem with Derian conducting her business from remote locations.

    ?In the 21st century, people operate on their cell phones,? he said in the article. ?How can anyone say whether I?m in my office or not at any time? And it doesn?t make sense to me that I should be required to be.?

    Derian told the Salt Lake Tribune her business was still up and running on Thursday.

    Although three of her employees have been arrested for prostitution in Utah, Derian said Black Rose Enterprises is not a prostitution company. She said employees who engage in sexual acts while on the job are fired.

    Derian?s maid service can operate in Arizona because she has a business license for it there. However, city officials from West Point said she needs a license from a Utah city for Black Rose Enterprises to operate in the state.
